Terms of use

A Centurio LLC operates the brand Actuallistings and requires users to explicitly acknowledge and agree to abide by the following terms when utilizing our services.

Real Estate License Requirement

To publish a property listing on Actuallistings, all real estate professionals must be duly registered with the New York Department of State Division of Licensing Services. Each agent is required to upload a copy of their license or pocket card and provide accurate contact information on Actuallistings. Agents must maintain an active license status, as Actuallistings reserves the right to remove individuals with expired licenses from the platform. These measures are implemented to ensure compliance with licensing regulations and to promote effective communication among all involved parties.

Exclusive Listings Policy

Actuallistings maintains a strict policy of accepting only exclusive sale or rental listings. All listings on Actuallistings must include a complete address and accurate unit numbers. Actuallistings reserves the right to verify the accuracy of unit numbers by reviewing the Offering Plan or other relevant documentation. If a listing’s authenticity cannot be substantiated, Actuallistings may remove it without prior notice. Advertisers who repeatedly post listings with inaccurate unit numbers may be subject to probation or suspension of their Actuallistings account. As a result, only the designated Listing Agent with a valid exclusive agreement is permitted to advertise such listings. If Actuallistings cannot verify the presence of a legitimate exclusive agreement, it retains the authority to remove the listing without warning. Actuallistings may also request official documents for verification purposes at its discretion. Maintaining accurate status information for each listing is essential on Actuallistings. If any account provides misleading information regarding the status or availability of a property, Actuallistings reserves the right to restrict that account’s ability to post listings on the platform.

Scope of Services

The services provided by Actuallistings are strictly limited to residential real estate. Actuallistings does not permit the advertising of individual rooms for rent. To maintain fairness and avoid duplication, only a single instance of a sale or rental listing is allowed on Actuallistings. For completed sales transactions, the listing agent is required to declare whether they acted as a dual agent or identify the selling agent involved. In rental transactions, the listing agent must indicate if they acted as a dual agent or clarify their representation, whether for the tenant’s agent or the landlord’s agent. Multiple listings of the same unit by different brokerages, landlords, or owners will not be approved. To advertise a listing as “new,” it must have been off-market for at least 60 days. If a new agent assumes representation of the listing from the same brokerage, the Days on Market (DOM) counter remains unchanged.

FSBO & FRBO

Please be advised that Actuallistings reserves the right to request official documentation, including but not limited to a driver’s license, deed, stock certificate, or other relevant materials, to verify the accuracy of the information provided in FSBO (For Sale by Owner) and FRBO (For Rent by Owner) listings.

Past Transactions

To ensure the authenticity of reviews, Actuallistings enforces a restriction of two reviews per property, capturing the perspectives of both parties involved (buyer and seller, or owner and renter).

Compliance with Housing Laws

All users are required to comply with the NYS Housing and Anti-Discrimination Notice.

Enforcement of Terms

In the event that Actuallistings identifies any violation of its terms of use or New York State policies, we reserve the right to take appropriate action, which may include removing listings (in whole or in part), terminating your account(s), restricting your access to the services, or suspending your account.

Warranty Disclaimer

THE ADVERTISER ACKNOWLEDGES AND AGREES THAT THEY ASSUME ALL RISKS ASSOCIATED WITH THE USE OF ACTUALLISTINGS SERVICES. IN ACCEPTING THESE RISKS, THE ADVERTISER BEARS SOLE RESPONSIBILITY FOR EVALUATING THE LEGITIMACY AND ACCURACY OF THE ADVERTISING MATERIALS. THE SERVICES ARE PROVIDED “AS IS,” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ANY IMPLIED WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE, WHETHER IMPLIED BY STATUTE OR OTHERWISE IN LAW. ALL REPRESENTATIONS, WARRANTIES, COVENANTS, AND INDEMNITIES SET FORTH IN THIS AGREEMENT WILL REMAIN IN FULL FORCE AND EFFECT EVEN AFTER THE TERMINATION OF THIS AGREEMENT.

Liability Disclaimer

THE ADVERTISER ACKNOWLEDGES AND AGREES THAT ACTUALLISTINGS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE ADVERTISER’S USE OF THE SERVICES. THIS INCLUDES DAMAGES ARISING FROM THE ADVERTISER’S USE OR MISUSE OF ACTUALLISTINGS, ANY INABILITY TO ACCESS THE SERVICES, OR ANY INTERRUPTION, SUSPENSION, MODIFICATION, ALTERATION, OR TERMINATION OF THE SERVICES. THE ADVERTISER FURTHER ACCEPTS THAT ACTUALLISTINGS SHALL NOT BE RESPONSIBLE FOR ANY UNAUTHORIZED USE OF THE ADVERTISING MATERIALS BY THIRD PARTIES. ACTUALLISTINGS’S LIABILITY FOR DAMAGES RESULTING FROM THE ADVERTISING MATERIALS IS EXPRESSLY LIMITED TO THE ACTUAL AMOUNT PAID FOR PUBLISHING THE AD. THESE LIMITATIONS OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

Dispute resolution

BY ACCEPTING THESE TERMS, YOU AGREE THAT BOTH YOU AND ACTUALLISTINGS WAIVE THE RIGHT TO A TRIAL BY JURY AND THE ABILITY TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, PRIVATE ATTORNEY-GENERAL ACTION, OR ANY OTHER REPRESENTATIVE PROCEEDING. UNLESS OTHERWISE AGREED TO IN WRITING BY YOU AND ACTUALLISTINGS, THE ARBITRATOR SHALL NOT CONSOLIDATE CLAIMS OF MULTIPLE PARTIES OR PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING. TO INITIATE ARBITRATION, YOU MUST PROVIDE WRITTEN NOTICE TO THE OTHER PARTY. IF YOU NEED TO PROVIDE NOTICE TO ACTUALLISTINGS, PLEASE SEND IT TO Email YOUR NOTICE MUST INCLUDE: (A) YOUR NAME, POSTAL ADDRESS, PHONE NUMBER, AND EMAIL ADDRESS, (B) A DETAILED DESCRIPTION OF THE NATURE OR BASIS OF THE DISPUTE, AND (C) THE SPECIFIC RELIEF YOU ARE SEEKING. IF YOU AND ACTUALLISTINGS CANNOT REACH AN AGREEMENT TO RESOLVE THE DISPUTE WITHIN THIRTY (30) DAYS AFTER THE NOTICE IS RECEIVED, EITHER PARTY MAY INITIATE ARBITRATION, AS PROVIDED UNDER THIS AGREEMENT. THE ARBITRATION WILL BE ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (“AAA”).
